The Witness Protection Act 1994 (the Act) commenced on 18 April 1995. Subsection 30(2) of the Act requires than an annual report be prepared which advises Parliament on the general operations, performance and effectiveness of the National Witness Protection Program (NWPP), and on the exercise of the Commissioner's powers under section 27 of the Act. The Act also provides that the report must be prepared in a manner which does not prejudice the effectiveness or security of the NWPP. The NWPP has carried out 19 witness protection operations since the Act commenced, providing protection for a total of 50 persons (including two foreign witnesses who have given evidence in judicial proceedings in Australia). The duration of participation in the program varies considerably, according to circumstances. Multiple trials and continuing court delays have hindered the early re-assimilation of some witnesses into the community. The operations and administration staffing of the NWPP is provided wholly by the Australian Federal Police and AFP staff members. Basic administration costs and salaries of witness protection police and staff members are met from within the AFP budget.
