LARCENY.
Heniy West and Timothy West were charged
in company, with stealing a coat tho property of
Michael O'Mara.
Mr. Gordon appeared for the accused.
Samuel James deposed : I am a farmer residing
at Stoney Creek, I saw the accused, Timothy
West at a ball at Wombat on the twentieth of last
month : I wore a macintosh over-coat that night;
the coat produced is the one I was wearing; I was
in the ball room when I took the coat off and put
it in a room ; Timothy West came in tlie room
just afterwards; he was sitting on the coat; I did
not ask accuscd anything about the coat when I
missed it; I did not authorise - him to take it
away; the coat is the property of Michael
O'Mara; I borrowed it.from him.
Michael O'Mara deposed: I am a grazier and
farmer residing at Tumblelon; I lent a coat to
Samuel James a short time ago; the coat produoed
is the same ; I paid £1 2s 6d for it 1 now value it
at £1 ; I did not authorise either of the accused
co take the coat.
This was the case for the prosecution,
Mr. Gordon said that the accused, Timothy
West, pleaded guilty. He also said he would
plead guilty to a charge of reeeiving for Henry
West.
His Worship postponed .the passing of sentence
pending tho hearing of another charge, preferred
against the accused.
Timothy West and Henry, West were charged
with stealing a saddle the .property of Patnck
McGuire of Walleudbeen.
Mr. Gordon appeared for the accused,
Prosecutor not having appeared when his
name was called Sub-Inspector Byrne said" that' he
had received a telegram -saying that Mr.
McGuire would be present. He expected that
he would arrive about twelve o'clock,
His Worship said that prosecutor should be
present when tne court opened. The accused was
there, their. solicitor was present, and the prosecutor
should be there, so that the'charge could be
gone on with. Tlie time of ihe court should
not be wasted in this manner.. .
Mr, Gordon suggested that 1 the case be re*
manded until two aclopk and it was postponed
till that hour.
Prosecutor having appeared'whe'u the school
cases had been disposed of, the bearing of the
charge was proceeded with. ' "

I do liot know either of the accused; on the
31sl July I reported to the police at Cootamundra
that I had lost; two saddles, two bridles, one breast
plate and two saddle cloths; I .have not seen the
property sineo until I saw the saddle (now produced)
in the oourt it is the property of cme' of my
sons ; I have no doubt that it is his saddle; there
are marks about the saddle' by which I can
identify it ; a new girth has been placed in it by
which I can remember it; remember the-maker's
name on thq saddle; reported the natqo to the
police, I also reported that ttye off pad was loose ;
it is -loose at tlie present'time; I Value the saddle
at about £3; I missed the s$d4'e on
