As Australia confronts accusations of  

genocide in the stolen children re-  

port and grapples with the Wik de-  

cision, how does our performance on the  

rights of our indigenous people compare  

with the rest of the world?  

In an Australian first, new masters course  

beginning at UNSW next semester will  

look at laws adopted in Europe, North  

America, Asia and Africa in attempts to  

accommodate the rights of indigenous peo-  

ples on those continents.

ulty of Law, Dr Sarah Pritchard, will  

conduct the course, International and Com-  

parative Indigenous Legal Issues, for four  

hours over seven Saturday afternoons.  

The course, which Dr Pritchard hopes will  

attract students from “as many disciplines  

as possible,” will also look at Australia’s at-  

tempts to come to grips with indigenous  

rights.

dren from their families, Dr Pritchard wants  

the course to “contribute to more informed  

debate on indigenous law”.  

“There is not much rational consideration  

of options for resolving differences and  

developing sounder relationship between  

indigenous and non-indigenous people in  

Australia,” Dr Pritchard said.  

She believes this failing is partly result of  

limited knowledge and understanding of  

legal history relating to settlement laws and  

the rights of indigenous people.  

“There is also limited appreciation of the  

extent of dispossession in Australia,” she  

said.  

“In Australia 85 per cent of our indigenous  

population is dispossessed, while in North  

America 85 per cent of the indigenous  

population continues to have relationship  

with their traditional territories.”  

International initiatives explored in the  

course range from separate Parliaments es-  

tablished to advise Scandinavian  

governments on issues relating to indig-  

enous Lapp communities, to recent moves  

by the Japanese government to recognise  

the Ainu as an indigenous people.  

International and Comparative Indigenous  

Legal Issues will move from the writings of  

Spanish scholastics, who in the 1540 af-  

firmed the rights of indigenous peoples, to  

the critiques of indigenous scholars and  

activists writing on mainstream debates on  

indigenous rights.  

It also looks at treaties adopted by settlers  

in New Zealand and North America, as  

well as the success of indigenous people  

over the past 20 years in having their rights  

recognised under international law, despite  

the limitations of international law in deal-  

ing with these rights.  

The specific roles of the League of Nations,  

the International Labour Organisation and  

the United Nations in shaping indigenous  

rights are considered in the second part of  

the course.  

In the final weeks, students will compare  

attempts to recognise and entrench indig-  

enous rights.

This analysis will extend from Canada to  

Sweden, down to the Noakhwe bushmen  

of Botswana and Twa Pygmies in Rwanda,  

to the Ainu in Japan, the indigenous people  

of the Thai/Burraa border and Chittagong  

Hill Tracts in Bangladesh,  

Dr Pritchard’s experience in indigenous  

law includes doctoral thesis on the inter-  

national legal protection of ethnic  

minorities, completed at the University of  

Tuebingen in Germany.

Twin study finds genetic link  

UNSW twin study indicates Attention-  

Deficit Hyperactivity Disorder (ADHD)  

is an inherited condition, according to  

UNSW psychiatrist Dr Florence Levy.

he study has revealed that when at least  

one twin has ADHD, there is 91 per cent  

chance the other identical twin will have  

the condition as well.  

Dr Levy, from the UNSW School of Psy-  

chiatry, is leading the study which has  

analysed data on nearly 2,000 Australian  

families with twins and other children aged  

between four and 12 years.  

Dr Levy began the study in 1991) with  

follow-up study in 1994 and another  

planned for the end of 1997.  

The June edition of the Journal of the  

American Academy of Child and Adoles-  

cent Psychiatry will publish results of the  

study in paper titled ADHD: Category  

or Continuum? Genetic analysis of large  

scale twin study.

Top ranking  

in Asia  

for UNSW  

The University of New South Wales led  

the way for Australian universities in  

survey of Asia’s top 50 academic institu-  

tions by prominent business magazine  

Asiaweek.  

UNSW was ranked sixth overall and the  

University of Melbourne was ranked ninth  

in the survey. They were the only two Aus-  

tralian universities to finish in the top 10.  

However, Australia had eight universities  

in the list more than any of the 15 other  

countries included, with Japan coming in  

second with six.  

And there were seven Australian institu-  

tions in the top 24, with the Australian  

National University ranked 13th, ahead of  

the University of Sydney (14th), Monash  

University (17th), the University of  

Queensland (21st), the University of Ad-  

elaide (24th), and the University of Western  

Australia (46th).  

Japan had the top two institutions in the  

poll, with the University of Tokyo coming  

in comfortable first ahead of Kyoto Uni-  

versity.  

The magazine rated institutions on points  

system covering nine categories, including  

academic reputation, financial resources,  

selectivity of students, and students per  

teacher.  

UNSW’s highest rating was fifth for finan-  

cial resources, while the magazine said the  

University was also renowned for its strong  

research programs and art school.  

The University of Melbourne rated third  

among the 50 for academic reputation,  

which was derived by all Asian universi-  

ties ranking their peers in the region.  

Australia’s second oldest university was  

noted as particularly Asia-oriented and as  

having diverse range of courses.  

Asiaweek said Australian universities rep-  

resented cheaper alternative to Asian  

parents than sending their children to  

study in the United States.
