THE  

This lecture will tell the strange story of how the Common-  

wealth's power to give money to the States led to the Common-  

wealth's monopoly of Income taxation.

began by setting out the source and nature of the Common-  

wealth's power to give money to the States.  

Section 96 of the Commonwealth Constitution reads as  

follows:  

"During period of ten years after the establish-  

ment of the Commonwealth and thereafter until the  

Parliament otherwise provides, the Parliament raay grant  

financial assistance to any State on such terms and  

conditions as the Parliament thinks fit."  

An earlier section. Section 87, known as the Braddon  

Clause and sometimes called, offensively, the "Braddon Blot",  

said:  

"During period of ten years after the establish-  

ment of the Commonwealth and thereafter until the Parliament  

otherwise provides, of the net revenue of the Commonwealth  

from duties of customs and of excise not more than one  

fourth shall be applied annually by the Commonwealth  

towards its expenditure,"  

The balance was to go for the benefit of the States.
