XMTERPRETATIOW  

How should we interpret Constitution* which  

is after all frame of Governments Should we interpret it  

as if it were an ordinary Act of Congress or of Parliament  

that is to say, narrowly and literally? That is to say as  

if it were Police Ã”f fences Act. don’t think that anybody  

will support this view of interpretation. Indeed if the High  

Court of Australia had supported it, the meaning attached and  

al  

the operation given to the Defence Power or even the Post/and  

Telegraphic power would have been very different from what  

has in fact been the case. In the case of the Defence Power  

I’ll come back to this at later stage in these lectures.  

So that the first principié to be narrow and literal and  

restrictive must, think, be rejected. Indded your Supreme  

Court long ago rejected it and so has the High Court of  

Australia.  

Well there is second possible way of  

interpreting the Constitution. Should we interpret the words  

loosely and politically? If politically, that is to say  

responding to the currents of social opinion, then interpretations  

will fluctuate according to the political complexion of the  

judges, make no criticism of anything that happens in this  

great country when say that reject this notion because  

 

agree with something will quote from Mr. justice Dixon
