Minister fails to respond  

on secondary  

organisation

Federation has had no response to  

its call for negotiations on state-  

wide policy framework for the  

organisation of secondary educa-  

tion. Federation has met once  

with the Minister and written  

three letters since Annual  

Conference.  

Federation is deeply concerned  

by the lack of consultation over  

proposals to restructure sec-  

ondary schooling in Dubbo, Mt  

Druitt and Blacktown.  

Annual Conference demanded  

moratorium on further changes  

pending the establishment of  

joint committee to establish  

state-wide policy framework.  

The Minister and the Director-  

General continue their campaign  

to deregulate and restructure sec-  

ondary education. Their strategy  

is reminiscent of that used under  

the previous government under  

Your Schools Right to Choose.  

Federation has been conduct-  

ing meetings of secondary dele-  

gates from high schools and cen-  

tral schools to hear reports and  

vote on recommendation which  

includes industrial action.  

Developments will be reported  

on the Federation’s Flotline.

Secondary teachers meet to discuss the  

organisation of secondary education.  

Pre-disciplinary  

award opposed  

by Denise Fairservice  

The Department of Education and  

Training (DET) has opposed  

Federation’s application for  

pre-disciplinary award. The  

Federation application is intended  

to cover all disciplinary matters  

(with the exception of efficiency)  

up to the time of charging. This  

would cover matters involving  

investigation by the Case  

Management Unit (CMU) as well  

as fraud.  

The award was lodged on June  

11. The matter was listed for  

mention in the Industrial  

Relations Commission (IRC)  

before Justice Monica Schmidt  

on June 18. At that mention, DET  

announced it was opposed to the  

award application and was seek-  

ing dates for hearing of prelim-  

inary argument that the IRC did  

not have the jurisdiction to make  

the award. Justice Schmidt did  

not give dates for that preliminary  

hearing and directed DET to pro-  

vide Federation with its prelimi-  

nary legal arguments and discuss  

with Federation the substantive  

matters in the award.  

Federation received the pre-  

liminary legal arguments on July  

22. Those arguments go to the  

Director-General’s discretionary  

powers under the Teaching  

Services Act and Regulation and  

also that the award is an extra  

claim on our present salaries and  

conditions award. Federation’s  

legal advice is that these argu-  

ments are challengeable.  

The parties also met on July 27  

to discuss the substantive matters  

of the award. DET argues that it  

cannot comply with the time-  

frames proposed by Federation in  

the award to ensure fair processes  

for members.  

Despite their willingness to  

discuss some of their procedures  

they are still opposed to the mak-  

ing of the award.  

The matter was listed for  

report back before Justice  

Schmidt on July 28. Menzies QC  

appeared for DET and reiterated  

that while DET was willing to  

discuss its CMU procedures, it  

was fundamentally opposed to an  

award.  

The matter is due back in the  

commission on August 26. It is  

clear that the award application  

will be opposed and there is  

likely to be jurisdictional argu-  

ment prior to any arbitration of  

the award.

anniversary with feature  

spread on pages 12—13 and
