Negotiations on TAFE  

dispute continue  

Stopwork action to proceed on December 9.

Over the last two weeks there have  

been negotiations with senior  

Government officials to attempt to  

resolve the TAFE dispute. To date,  

however, no settlement has been  

possible andboth TAFE and school  

working conditions remain under  

serious threat.  

Action must he taken now. Be-  

cause the attack on TAFE has  

significant implications for all  

teachers, Federation Council  

has determined that stopwork  

meeting of up to three hours will  

be held on Wednesday December  

9. These meetings will include  

all TAFE teachers and delegates  

from schools.  

Attendance is vital. Reports  

will be provided to the meetings  

on progress, or otherwise, made  

in negotiations with the Govern-  

ment and if necessary consider  

proposals for further industrial  

action in early 2010.  

Members should check the  

Federation website for venues of  

meetings and any developments  

and negotiations between the  

Government and Federation. If  

there is an acceptable settlement,  

the stopwork meeting will consid-  

er recommendation to accept  

the settlement.  

The dispute centres on the  

fact that as result of the Depart-  

ment of Education and Training's  

(DET's) successful application in  

the Industrial Relations Commis-  

sion, TAFE teachers can now he  

required to teach up to 35 hours  

face-to-face per week at any time  

between 6am and 10pm, Monday  

to Saturday. In addition, they will  

be required to attend for 35 hours  

per week and teach an additional  

36 hours per year. If long service  

leave is taken before and after va-  

cations, the whole period will be  

counted as long service leave.  

If these conditions are allowed  

to stand for TAFE, it is clear school  

teachers will he next. School teach-  

ers could be required to teach in-  

creased numbers of hours, attend  

school for longer periods, lose  

their long service leave to fund  

school vacations and be directed  

on how to use their release time.  

An attempt was made by DET to  

apply conditions such as these to  

teachers in their 1999 award ap-  

plication. Thousands of teachers  

showed their contempt for this  

attack by throwing copies of the  

award application over the gates  

of Parliament House in Macquarie  

Street at that time. Unfortunately,  

there are those in DET who would  

like to resurrect this application.  

The strength of Federation is  

based on all our members work-  

ing together to support public  

education and each other. We  

cannot allow the Department  

to divide us. If no resolution is  

reached, school-based delegates  

will hear the report and consid-  

er what joint action of school and  

TAFE members will be necessary  

to protect the working conditions  

of all public education teachers.

Protesters draw first feted blood  

Teachers from Sydney Institute's Design Centre at Enmore wear their hearts on  

their sleeves in creative protest against the Department of Education and Train-  

ing’s agenda for TAFE. The group stopped work for the afternoon on November  

26, hopped on mini bus to Red Cross blood bank and donated some of their  

vital fluid in an act of generosity potent with symbolism. “The Department has  

even come up with plan to rob us of our hard-earned long service leave, so we are  

saying today we will give our blood away before they come up with plan to take  

that from us as well,” Fed Rep at the centre, Stephen Whittaker, said. Needless to  

say, Red Cross was not party to the protest.  

Gillard in  

league of her own  

Six major organisations representing  

parents, teachers and principals have called  

on Julia Gillard to stop school league tables.  

Parents, teachers and pf\ncipals  

have united to urge the Federal  

Government to take action to  

prevent the creation and publica-  

tion of misleading and damaging  

school league tables.  

The call came in letter to  

Deputy Prime Minister and Edu-  

cation Minister Julia Gillard on  

November 17.  

The letter was signed by the  

Australian Education Union, the  

Independent Education Union,  

the Australian Council of State  

School Organisations, the Aus-  

tralian Parents Council, the Aus-  

tralian Government Primary  

Principals Association and the  

Australian Secondary Principals  

Association.  

The letter said:  

"As parents, teachers and prin-  

cipals we welcome the Austral-  

ian Government's commitment  

to lift the achievement of all our  

students through the provision of  

quality education in schools. In  

striving to meet that commitment,  

we all recognise that it requires  

strong evidence-based policy de-  

cisions around quality teacher  

training, skilled teachers in all  

schools, the provision of curricu-  

lum which meets the needs of all  

students, and support for school  

communities as they work to pro-  

vide the very best education for  

their children. Any change must  

be managed with care and driven  

by sound evidence.  

"We are writing to you because  

of our shared concern that one  

aspect of your program threatens  

to harm the future opportunities  

of Australian students. There is,  

we believe, serious risk to school  

communities students, staff  

and parents through the publi-  

cation of school data by ACARA.  

"NAPLAN testing provides  

snapshot of academic achieve-  

ment in small, yet significant,  

part of the curriculum. Parents  

receive picture of their child's  

skill development in literacy and  

numeracy and it gives teachers  

and principals reference point  

for evaluating professional prac-  

tice in their school.  

“Important as NAPLAN may  

be, its limitations are considera-  

ble and include the following.  

•"NAPLAN was not designed for  

the purpose of measuring school  

performance and certainly is not  

able to reliably measure overall  

year-to-year student improve-  

ment.  

•"There are large margins of sta-  

tistical error evident in tests such  

as NAPLAN.  

•"Combining individual student  

results into school average does  

not provide sound basis for com-  

paring schools.  

•"The complexities found within  

school population social, eco-  

nomic, etc do not allow rea-  

sonable comparative data to he  

gained through the administra-  

tion of one or two brief tests cov-  

ering very limited part of the  

curriculum.  

"There is considerable evidence  

that the inappropriate use of data  

to compare schools can have se-  

rious negative impacts, both on  

the testing itself and on the very  

schools and children it was in-  

tended to help. Allowing student  

data to be inappropriately or mis-  

chievously used for the creation  

and publication of league tables  

could exacerbate the difficulties  

of the communities concerned,  

narrow the school curriculum  

and risk the testing process itself  

becoming corrupted.  

"The United States and United  

Kingdom experiences of league  

tables offer clear and definable  

warning to the Australian Gov-  

ernment and to all education  

decision-makers. Whether it be

Workers compensation and  

vacation pay  

The Department of Education and Training has introduced changes that may adversely affect vacation pay for  

those members in receipt of weekly workers compensation payments at the commencement of the Christmas va-  

cation. So that advice can be provided to minimise the risk of this, all members who are likely to be in this position  

should contact Federation Welfare Officer on (02) 92172100 or 1300 654 369 before the vacation commences.  

Federation office will close at spm on Friday, December 18.
