Fix this textLast year the Director General of Education
Fix this textissued a memorandum on L.S.L., L.W.O.P. and
Fix this textRetirement. The changes involved were yet another
Fix this textattack on teachers’ working conditions. The attack
Fix this texton L.S.L. attempted to force teachers to take leave
Fix this textonly in one term lots unless special compassionate
Fix this textcircumstances existed.
Fix this textThe Federation protested stating that the
Fix this textchanged conditions were contrary to the statute
Fix this textcovering L.S.L. (The Teaching Services Act) in that
Fix this textteachers who have through long service earned a
Fix this textright to take L.S.L., were now being told that they
Fix this textcould not take it unless such leave complied with
Fix this textthe Director General’s memorandum. In other
Fix this textwords a teacher who, after ten years service, had
Fix this texta right to take two months L.S.L. on full pay or
Fix this textfour months L.S.L. on half pay was being told
Fix this textthat such leave did not comply with the new
Fix this textguidelines and therefore could not be taken.
Fix this textAfter prolonged negotiations with the Federation
Fix this textthe guidelines were revised in an attempt to get
Fix this textround the obvious illegality of the original
Fix this textmemorandum. The revised memorandum, issued
Fix this textin October, permitted a teacher without a whole
Fix this textterm’s leave credit to take the balance of that term
Fix this textas L.W.O.P. This would have forced a person with
Fix this textan entitlement to paid leave to take a portion of
Fix this textleave as unpaid leave. Another “liberalizing”change
Fix this textwas to permit a smaller amount of leave to be added
Fix this textto a vacation period, such leave to be able to be
Fix this texttaken only once every five years. As negotiations
Fix this texthad broken down the Federation notified the
Fix this textIndustrial Commission'that a dispute existed and
Fix this textsought the assistance of the Commission in
Fix this textconciliating the dispute. Conciliation proved to be
Fix this textimpossible and so the Federation made application
Fix this textfor an award covering the taking of L.S.L. in the
Fix this textEducation Teaching Service. The case came before
Fix this textMr. Justice Macken on February 6 1989.
