Fix this textTHE RIGHTS OF A LESSEE
Fix this textRecently the English Kennel Club upheld an
Fix this textowner’s contention that she was eligible to
Fix this textexhibit a bitch in her name although she had
Fix this textregistered a lease for it in favour of another
Fix this textparty. The club has two rules bearing on the
Fix this textquestion. One is for the registering of leases
Fix this textof bitches specifically for breeding purposes. It
Fix this textmakes no provision for males or for any other
Fix this textkind of lease. The other states that the ex-
Fix this texthibitor of a dog or bitch must be solely and
Fix this textunconditionally the owner of it. The decision
Fix this textgiven in favour of the owner as against the
Fix this textlessee might be considered the best under the
Fix this textcircumstances because the lease was for breed-
Fix this texting purposes only, and the lessee acquired no
Fix this textright to exhibit. On the strict interpretation
Fix this textof the two rules, however, it seems that neither
Fix this textparty is eligible to exhibit the bitch because
Fix this textneither is the “unconditional” owner of it.
Fix this textFrequently leases are arranged under which
Fix this textthe lessees receive the right to exhibit dogs and
Fix this textbitches as well as use them for breeding, but
Fix this textthe English Kennel Cilub’s rules would leave
Fix this textsuch a lessee lamenting, since those rules
Fix this textacknowledge only the right to breed.
Fix this textSuch a position could not arise under the
Fix this textrules of the Kennel Control Council. These
Fix this textrules cover both the owner and the lessee by
Fix this textproviding that the exhibit must be one of two
Fix this textthings—(a) solely and unconditionally the pro-
Fix this textperty of the exhibitor, or (b) leased by the
Fix this textexhibitor. A leased exhibit is no longer solely
Fix this textand unconditionally the owner’s hence the
Fix this textlessee is the only one . eligible to exhibit it.
