HEALTH FUND  

lesbian couple is to sue major national health fund  

for breach of contract. Louise Marsden, Teresa Savage  

and their children had taken out family membership of  

another fund in Marchl99o. This fund was taken over by  

the couple's current insurers in October 1990 and cover  

continued, with claims being honoured and their  

membership renewal being accepted in March this year.  

In May the fund informed them that cover for Teresa and  

her biological child had been withdrawn. This was done  

on the grounds that family membership may only include  

opposite sex partners and their children.  

Teresa and Louise contacted the fund immediately  

asserting that this was an act of blatent discrimination  

and could constitute an illegal breach of contract. After  

providing proof that showed Louise was the legal  

guardian of the child that had been excluded that child  

was re-instated. Teresa had to take out single person's  

policy.  

The couple next approached the Anti-Discrimination  

Board for help. Anne Scahill of the ADB says "their legal  

situation isn't clear. state body (ADB) may not be able  

to deal with Federal matter. The fund is covered by  

Federal law and at that level no anti-discrimination  

legislation exists."  

The Operations Manager of the health fund concerned  

refused to discuss the matter with LOTL.  

Teresa and Louise will now take legal action with Teresa  

also wanting to be compensated for the cost of her single  

person's policy. The couple did not want the health  

fund's name disclosed as they felt it could harm their  

chances of succeeding. They would like to receive letters  

of support and can be contacted at PO Box 22 Leichhardt  

2040.

NAVY HUNTS  

OUT DYKES  

The Navy is investigating complaints of lesbian behaviour at HMAS  

Kuttabul. Three women have been asked to show why they shouldn't  

be discharged and two others will be disciplined internally.  

Navy spokesman refused to comment on the incident, except to  

say that it occured on base. "What they do in their own time is up to  

them." He was concerned by the possible HIV risks of having  

lesbians in the Navy, despite information that suggests dykes comprise  

one of the lowest risk groups.  

His biggest worry though was the public relations aspect: "I don't  

want people ringing up thinking it's rife throughout the services."
