Pier Hotel, Fremantle.
GENERAL PUBLICAN'S LICENSE.
Patrick McCafferty applied for an hotel
license for premises situated in Point Street,
and known as Fiddler's cottages. Mr. Gawler
appeared for the applicant, and Mr. Kidson,
on behalf of himself as a ratepayer, and
others, to oppose. The applicant stated that
he proposed to improve the premises in
accordance with plans submitted. The build-
ing would contain thirteen rooms when com-
pleted.
Mr. Kidson based his objections on the
ground that there were several places of
worship in the neighbourhood of the pre-
mises, that licensed premises were not re-
quired in the localty and that the proposed
site of the hotel was almost opoosite the
Church of England parsonage. Farther he
submitted that the evidence given by the
applicant as to the premises not being at
present fit to receive the public, was a bar to
the application inasmuch as the words of
part of section 18 of the wines and spirits
Act were as follows:—"Every house for
which a publican's general license should be
granted .... shall at the time of the
granting of such license contain at least two
sitting rooms and two sleeping, actually
ready and fit for public accomodation," etc.
Mr. Gawler replied by quoting the conclud-
ing words of the same section which were as
follows :—" But in case on the granting of a
certificate for a licence by such justices as
aforesaid, it shall appear expedient to grant
such certificate upon any other conditions
with reference to the extent of accommoda-
tion to be afforded to the public in the afore-
said or any other respect it shall be lawful
for the said justices to insert such conditions
in the certificate for such license."
The bench after hearing the arguments de-
cided that a licensed house was not required
in the locality, and refused the application.
HOTEL LICENSE.
Adam Oliver, applied for an hotel license
for premises, containing 13 rooms, situate on
Pensioner Road North Fremantle. Mr. Gaw-
ler appeared for the applicant and Mr. Kidson
to oppose. An application was also made
by Andrew Wakely for a publican's general
license for premises to be built at the Rocky
Bay railway crossing, North Fremantle. Mr.
Mess appeared for the last named applicant
and Mr. Kidson to oppose. The applications
were heard simultaneously.
The applicants submitted plans showing
the capacity of their propesed premises. Mr.
Oliver stated that he had expended £1,400
in building his house, and Mr. Wakely stated
that the premises he proposed to erect would
cost £2,500 when furnished. The former
applicant's premises were situated about 7
chains from Mr. Bick's Swan Hotel and the
latter's about 1 mile and a quarter.
John Bick, licensee of the Swan Hotel, stated
that he nad nearly completed extensive im-
provements to his licensed premises which
would, when completed, contain sleeping ac-
commodation for 30 or 40 persons. He had
not found the accommodation deficient in the
past, but merely entered upon the erection of
additional premises in view of the future de-
velopment of the place. He anticipated that
his extended premises would afford ample ac-
commodation for two years to come.
Mr. Kidson put in two counter petitions
against the granting of further licenses in the
neighbourhood.
The Bench decided that an hotel license
would do no injury to the established hotel
and that apparently increased accommodation
would be required. The application of Mr.
Oliver would be granted, but as there ap-
peared no necessity for a public house, Mr.
Wakely's application would be refused.
BOARDING HOUSE LICENSES.
The application of W. D. Spiller for a
boarding house license for premises situate
at North Fremantle, was granted.
EATING HOUSE LICENSES.
The applications of Martin Blau and
Joseph Augier for eating house licenses for
premises in Fremantle were granted.
GALLON LICENSE.
The application of Geo. Roby Woods Wat-
son & Co., for a gallon license was granted.
