Introduction
Scope and Contents
The Home Office was responsible for colonial affairs until 1801, but the bulk of records affecting the colonies has been transferred to the Colonial Office. Most of the remaining records of interest to the Australian Joint Copying Project concern the convicts.
Among the main classes copied can be found the two earliest censuses held in Australia, the 1828 and 1837 censuses.

In 1782 the division of foreign business between the Northern and Southern Departments in Great Britain was abolished. Out of this administrative change was born the Home Office, assuming jurisdiction over domestic affairs of the realm.
The functions of the Home Office were then largely the transmission and answering of petitions to the Sovereign from his subjects, advice on the exercise of royal prerogatives, especially the 'prerogative of mercy', and the issuing of instructions on behalf of the Sovereign to Officers of the Crown, Lords Lieutenant, Magistrates, Governors of Colonies and others, in connection with the maintenance of law and order and the defence of the realm. The new Department also immediately became responsible for colonial affairs and remained so until 1801 despite the appointment of a Secretary of State for War and the Colonies in 1794. A number of duties of the Office have since been superseded and others added, control of the penal system being among them (1823).
Although the duties of the Home Office have been altered from time to time, the most important as regards Australian historical interest remains that of maintenance of the Sovereign's Peace. Under the sway of this power fall those disturbers of the peace, the convicts.

Series HO 10. Convicts, New South Wales and Tasmania, 1787 - 1859
64 itemsThis Series of records contains musters listing male and female convicts living in the Colonies of New South Wales and Tasmania. Included in these lists are particulars as to the ships on which the convicts were transported, the date of their arrival in the Colony, when and where they were convicted, the sentence, whether they were still living in the Colony, marital status, religion, a list of pardons granted, and if no longer a convict where they were presently employed. The amount of information varies from list to list.
These returns may be divided into four main groups:
1. New South Wales. Returns, Musters, Censuses etc. of convicts in the Colony. Included are some lists of free men. 1787-1837. (Vols 1-30, 32-37.) The censuses includes all residents except military, while the musters include only convicts and ex-convicts.
2. Tasmania. Lists of returns of convicts in Van Diemen's Land. 1808-1849. (Vols 38-51.)
3. New South Wales. Pardons. 1834-1859. (Vols 31, 52-55.)
4. Tasmania. Pardons. 1834-1837, 1841-1859. (Vols 31, 56-64.)

August 1822, general census NSW, including free settlers, convicts, children, wives, etc. The census excludes serving military, and does not include Tasmania.
The date of HO 10/36 was ascertained by comparing names with the families listed in P. C. Mowle's A Genealogical History of Pioneer Families of Australia (Sydney: John Sands, 1939). For example, Mowle (f. 302) records that George S., Son of George and Janet Ranken, was born on 31st March 1822. The same George S. is listed on HO 10/36 as being "3 months" old.
Arrangement is fairly strict alphabetical within each letter, except that families are usually listed together, following the name of the head of the family.
HO 10/38 provides names, children's ages, status as convicts or free settlers, ship names, sentences, and details of employment.
This piece also contains R-Y of NSW 1837 convict muster.

Arrangement is by letter but not alphabetical within letter, with females listed seperately at the end of the male list for each letter of the alphabet.

Series HO 11. Convict Transportation Registers, 1787 - 1870
22 itemsThese registers contain lists of convict ships and persons transported. The ships are arranged in order of their departure from the United Kingdom, with the date of sailing and destination. The names of convicts are arranged in alphabetical order according to the place of conviction. There are three types of registers:
1. Lists of convicts transported in particular ships, 1787-1867. Volumes 1-19.
2. An index of colonies and a list of ships transporting convicts, 1787-1870. Volume 20.
3. An account of the number of convicts transported, 1787-1870. Volume 21.
Each piece is preceded by an index to ships, showing dates, folio numbers, and date of sailing (only for English ships, not Irish).
If a ship stopped at Gibraltar/Bermuda then a listing of Irish convicts may be included. It seems some Irish convicts were taken on board at Gibraltar/Bermuda and shipped to Australia, especially during 1853-1867.

108 itemsThis Series is comprised of copies of out-letters, warrants and pardons from the Secretary of State for the Home Office. Letters include those to Justices of Assize Courts, Sheriffs, Mayors and private individuals who have presented petitions to the Home Office regarding certain prisoners. The letters have been copied chronologically. Volume 5 is the only volume that has been filmed with an index.
Warrants issued soon after trial state which hulk a convict was to be kept on.

9 itemsMmonthly returns by the Clerk of the Sessions concerning the prisoners committed for trial at the Sessions of Oyer and Terminer and Gaol Delivery for the City of London and County of Middlesex, with the charges laid against them, the verdict and sentence. Age of the prisoners is noted from April 1834. The arrangement of names is in order of the severity of the sentence, from death and transportation for life, to delivered by proclamation. Each month has a separate return for London and Middlesex and from November 1834 (Volume 5, f. 255) the returns are under the general heading of Central Criminal Court with a separate listing for London, Middlesex, Essex, Kent, Surrey and Admiralty.

56 itemsR registers listing for the county of Middlesex all persons charged with indictable offences, 1791-1849. The lists contain the person's name, description, birthplace, the alleged crime, the sentence - whether death, transportation, or a term of imprisonment - and when the sentence was executed. Acquitals are also noted, and in the case of transportation, the date and to whom the prisoner was delivered.

5 itemsThis Series comprises original in-letters from the Secretary for War and the Colonies to the Home Office and an entry book of out-letters from the Home Office to the War and Colonial Office mainly dealing with convicts, their health and discipline.
'After the loss of the American Colonies... Colonial affairs were then taken over by the Home Secretary. A Third Secretary was, however, again appointed in 1794 to take charge of matters relating to the war then in progress; to him was transferred in 1801 the Colonial business of the Home Office, his title being thenceforward Secretary of State for War and Colonies. The strain of the Russian War of 1854 led to the creation of a separate Secretary of State for the Colonies...'. Guide to the Contents of the Public Record Office, Volume II (London, 1963), p. 52.

3 itemsThis Series is largely composed of Orders in Council received by the Home Office in connection with the establishment of the penal settlement in New South Wales, and the transportation of convicts to that Colony. It may be divided into two sections:
1. Orders in Council, 1786-1794. Volume 1.
These are arranged in chronological order mostly concerning Orders in Council appointing 'the Eastern Coast of New South Wales or some one or other of the islands adjacent to be the Place to which the said several offenders whose names are contained in the said lists hereunto annexed may be transported.'
The following lists give the name, sentence, place and date of sentence for each prisoner. These are neither in alphabetical nor chronological order.
2. Proceedings and Correspondence, 1785-1799. Volumes 14-15.
From these were copied seven letters, arranged chronologically, mostly from the office of the Committee of the Privy Council for Trade, concerned with agriculture, fishing and coinage for the Colony.
